Comments on rule questions, new interpretations, problems, unpopular Rule 62 (Redress) decisions, summary of the facts, conclusions and decisions of Rule 69 (Allegations of Gross Misconduct) actions, problems with Sailing Instructions or Notice of Race and experience with experimental procedures.
The 29er Europeans were held at Fraglia Vela Riva, with 251 boats divided into 6 groups across 3 racing areas. The qualifying series experienced light winds, resulting in only 5 races for each group. However, the final series offered superb sailing conditions with 8-9 races for each group. During the event, there were 31 hearings, 16 with request for redress due to physical damage - some of them serious damage. In one hearing, (reopening, the next day) we received a video from the protestee, who had been DSQ the previous day, which may contain new evidence. Opinions were divided within the jury, some of us said it was not new, and some wanted to see the video (WS Case 115). We decided to deny the reopening. - NORNF3
Discussion with IJ was not on whether the video evidence was “new” which it was agreed it was not but whether the IJ should also consider if it showed a possibility of “significant error” in the original facts found. We also had at least two hearings where the protestor had included the wrong party as protestee. As per new part 5 they could not amend this and had to resubmit a new protest that was then out of time with no good reason to extend. - GBRNM20
