Comments on rule questions, new interpretations, problems, unpopular Rule 62 (Redress) decisions, summary of the facts, conclusions and decisions of Rule 69 (Allegations of Gross Misconduct) actions, problems with Sailing Instructions or Notice of Race and experience with experimental procedures.
1. EXPANDING SI GOVERNING SUPPORT BOATS TO COVER SUPPORT PERSONEL AND BOATS

Prior to the regatta the IFDS accepted a request from the jury to include a modified Sailing Instruction 24, Support Boats of the Appendix L Sailing Instruction Guide that expanded the rules that govern some actions of support personnel. The proposed SI was based upon an SI used at the 2012 Olympics and Paralympics requiring a competitor to comply with any reasonable request from a regatta official. It added the ability to penalize the support person, the sailboat being supported or both for a breach.

The regatta SI was,

?24 SUPPORT-COACH PERSONNEL AND BOATS (DPI)

24.1 Team leaders, coaches and other support personnel shall comply with any reasonable request from a regatta official.

24.4 Penalties for infringing this sailing instruction may be applied to the offending support personnel and-or the boat or boats being supported. A penalty applied to a boat shall be applied to the race nearest in time to the incident.?

Jury members thought this SI gave them some jurisdiction and leverage over a support person who behaved badly during the regatta. The jury envisioned discretionary penalties to the support person ranging from agreeing to stay off the water for some period in return for no further action from the jury, to exclusion from the regatta shore based facilities by the regatta organizing authority, to point penalties applied to the boats being supported. The jury recognized that care must be taken to consider the additional and unique roles that on water support personal supply at IFDS events.

There were no incidents that warranted action under SI 24 during the regatta.


UNSPORTSMAN LIKE BEHAIVOR BY A SUPPORT PERSON

After racing on the third to last day the jury received a written report from a Course Race Officer asserting a gross breach of good manners and misconduct by a team coach. The International Jury concluded that since the actions described in the report might be a breach of a sailing instruction and might exceed the conduct described in rule 69.1, the report should be investigated.

The jury conducted the investigation using the same procedures mentioned in rule 69.2 and the IJ Manual in order to determine whether to report the individual?s behavior to his national authority and whether to penalize him or the boat he was supporting for a breach of a sailing instruction (see above).

The jury informed the coach in writing of the allegations that included a copy of the report from the Course Race Officer and the time and place of the investigative hearing. He was advised that he could bring someone to advise him during the hearing and that he could call witnesses.

The full jury (six members) conducted the hearing following the procedures in rules 63.2, 63.3(a), 63.4 and 63.6; except that the advisor was allowed to be present during the entire investigative hearing and to give testimony concerning the character of the individual and the history of his behavior.

The testimony, and the apologies offered and accepted before and during the hearing, led the jury to conclude that the individual showed sincere remorse for his behavior. The jury therefore decided to require the coach to write an apology that would be posted on the Official Notice Board; to take no further action under the sailing instructions; and to file no reports beyond including the details of the incident in the regatta report to the IFDS.

The jury considered this process to be a fair and thorough response to a report of a possible infringement of 69 by a non-competitor.
