Rule 44.3 was in effect and a boat was seen displaying a yellow flag at the end of the first leg and as she crossed the finish line displaying a yellow flag resulting in the race committee scoring the boat with a percentage penalty. The boat requested redress saying the flag had come unfurled by accident and the boat had not been involved in any situation or protested. The jury denied the request concluding the race committee had not made an error and the boat had not met the 'through no fault of her own' requirement of 62.1.
Later the jury discussed whether the race committee HAD made an error by adding the scoring penalty even though the boat had not met the second requirement of rule 44.3 (b), "... At that time [crossing the finish line or ... first reasonable opportunity... ] ... inform the race committee of the identity of the other boat involved in the incident.'
Had the race committee not assigned the scoring penalty because of an incomplete report, the result of the unintentional flag would have been 'no penalty', which was her requested redress. No conclusion was reached by the jury and the decision not to award redress stood.
Class officers were insisted that there be no discards in the series. This may signify a reversal in popular opinion towards ISAF's practice of assuming there are discards in a series (Appendix A2, Appendix K NOR 13, Appendix L SI 17).
