The RC protested 5 boats in Race 1 for not sailing the course. Mark 'Tango' is an inflatable mark that is set to keep the divisions that are racing around the islands from sailing through a W-L course set for other divisions. On the water, the RC announced the course over VHF for the Mini Maxi RC division by sequentially stating each rounding mark and its required side, except special mark Tango, which was announced after the regular course description. As a result, two thirds of the fleet did not record Tango in their written log and did not leave Tango on the required side. In the hearing, the RC stated that no advantage was gained because Tango was on the rhumb line between 'Echo' (the next to last regular mark) and the finishing line. The rules of the event provided for discretionary penalties for breaches of any rule except the rules in RRS Part 1 and Part 2. Consequently, the jury applied the World Sailing DP policy to the breach of RRS 28, giving each boat a percentage penalty applied to the corrected finishing place. It is unlikely that a DP can be applied to RRS 28 except in this limited situation, where the mark involved is on the rhumb line between two other marks, and the boats are on a beam reach.
