Comments on rule questions, new interpretations, problems, unpopular Rule 62 (Redress) decisions, summary of the facts, conclusions and decisions of Rule 69 (Allegations of Gross Misconduct) actions, problems with Sailing Instructions or Notice of Race and experience with experimental procedures.
Two points have been raised and were subject of an extensive discussion. One point referred to Jury informing a boat about its intention to protest afloat between races. Majority of judges felt it is not a right approach at the Youth event given the difference in maturity and mentality of the sailors. It was believed that as long as Jury shall inform a sailor about its intention to protest within protest time limit, it shall refrain from passing this information on the water between races. It was agreed that such policy will be followed throughout the Event. Second point referred to rule N1.4(b) that applied. Jury ran the hearings divided into two panels of 3 judges. This was ran smoothly and was well perceived both by the sailors and judges until the parties to a hearing requested a hearing by a full panel. Jury discovered that there is no guidance in the Manual nor rule indicating the right process to follow and decided to allow the parties to present their evidence and invite the witnesses to the room. In 2 out of 4 cases where a party asked for a full panel hearing, Jury decided it might have made a significant error and decided to reopen the hearing in question on its own initiative. Jury felt uncomfortable allowing the parties to tell their stories again given the indication in N1.4(b) that a party cannot question facts found but found it hard to deprive the party their rights to present evidence based on the fact that a word 'hearing' was used in N1.4(b) and that word is used in rule 63. It is strongly recommended to add a section in the Judges Manual indicating the right process and procedures to be applied when dealing with Part 2 hearing by a full jury. - POLZT1
