REINSTATEMENT FOR BEING COMPELLED FOR BREAKING BLACK FLAG RULE

Ten-seconds before a Black Flack start, a boat behind the starting line was hit in the transom and pushed over the line. She protested the overtaking boat. She also heard her number being identified as OCS on the Race Committee boat and knew she had been identified as breaking rule 30.8. She sailed the course, finished the race, and was scored BFD without a hearing.

She submitted a protest and asked for redresses because she had been forced to break the Black Flag rule by a boat breaking a Part 2 rule. Because she had not sailed to the pre-start side of the line, the International Jury concluded that she had not met the requirements of rule 28 and did not change her score.

This lead to a theoretical discussion as to what would happen if the Jury had concluded that the boat had been compelled to break the Black Flag rule AND had returned and started correctly. Our conclusions were: (1) the boat was not entitled to redress under rule 62 and, (2) the decision of her protest would be that the boat would meet the requirements of rule 64.1(c) and should be exonerated for being DSQed without a hearing for breaking rule 30.8-Black Flag. The scores of all boats in the race would be corrected to reflect her finish.
PRO PRE-HEARING MEETING WITH BOATS IDENTIFIED AS OCS

Six request for redress were withdrawn before the hearing when the PRO shared her tape of the start with the boats claiming their OCS had been in error. This non-confrontational approach by the PRO saved approximately five hours of hearing time.
